Información precontractual “YOUNIQ SEVILLA”
1. Objeto
a. “Youniq Sevilla“ es una residencia universitaria privada ubicada en la Calle Plácido Fernández Viagas, 6, Sevilla, 41013 (en adelante, la “Residencia”), propiedad de la mercantil Iberian Propco I, S.L.U. (en adelante, “Iberian Propco I”), N.I.F. B87229530, con domicilio social en calle Príncipe de Vergara, 112, planta 4a, 28002 Madrid y gestionada en nombre y representación de Iberian Propco I, S.L.U. por la mercantil Hartly Invest, S.L. (en adelante, “Hartly Invest”), N.I.F. B88226873, con domicilio social en calle Príncipe de Vergara, 112, planta 4a, 28002 Madrid
b. Al hacer clic en el botón "Reservar" en la página de reservas habilitada al efecto en la página web de la marca comercial YOUNIQ (https://youniq-living.com/es) (en adelante
el "Proceso de Reserva"), el interesado confirma su interés de obtener un derecho de alojamiento con Iberian Propco I (en adelante, la "Reserva"), otorgado en virtud
de la celebración de un contrato de hospedaje y alojamiento de temporada para estudiantes universitarios (en adelante, el “Contrato de Hospedaje”).
c. El interesado es (i) un estudiante matriculado en una universidad española o (ii) tiene intención de empezar a estudiar en una universidad española durante el curso 2021/2022 o (iii) un estudiante matriculado en una universidad extranjera y que está realizando parte de sus estudios en una universidad española, como parte de un programa de estudios en el extranjero (p.e. Programa Erasmus+) (en adelante, el “Interesado”).
2. Reserva
a. La Reserva del Interesado tiene como finalidad la celebración del Contrato de Hospedaje con Iberian Propco I y el otorgamiento de un derecho de alojamiento a favor del Interesado, en relación con una habitación en un apartamento o estudio de la Residencia, teniendo en cuenta los diferentes tipos de alojamiento que ofrece la Residencia y que se muestran a continuación:

b. En cuanto a la Reserva, Iberian Propco I cobrará al Interesado un gasto de gestión no reembolsable, a excepción de lo dispuesto en la cláusula 2c, por importe de CIENTO CINCUENTA EUROS (150,00 €), que el Interesado abonará durante el Proceso de Reserva, facilitando los datos de pago y realizando el cargo posterior mediante la tarjeta de débito o crédito indicada a estos efectos.
c. El Interesado declara en el marco del Proceso de Reserva, conocer y aceptar que la Reserva es únicamente reembolsable en el caso que Iberian Propco I omita señalar la
falta de disponibilidad real de habitaciones en la Residencia en el marco del Proceso de Reserva, en contra de la disponibilidad indicada en la página web y, en consecuencia, se niegue a aceptar la Reserva del Interesado (caso de overbooking).
d. El Interesado declara, aceptar y conocer, que, en particular, no tendrá derecho a reclamar el reembolso de la Reserva frente a Iberian Propco I en el supuesto de la (i) la
sustitución de clases presenciales por clases online en el marco de la pandemia actual causada por el virus SARS-CoV-2 (en adelante, la “Pandemia”), así como el cambio
a la enseñanza académica a distancia o (ii) la suspensión total o parcial de las clases académicas debido a la Pandemia.
e. Iberian Propco I, a través de Hartly Invest, podrá a su libre juicio decidir si le ofrecerá al Interesado una habitación en el tipo de alojamiento solicitado, lo que depende
principalmente de la disponibilidad de las habitaciones en la Residencia.
f. Una vez que el interesado inicie el Proceso de Reserva haciendo clic en el botón "Reservar" en la página de reservas habilitada al efecto en el sitio web de YOUNIQ, la administración de la Residencia (en adelante, la "Administración") le enviará un correo electrónico en relación con la tramitación de la reserva (en adelante, la "Confirmación de la Tramitación de la Reserva") dentro de un plazo de tres días hábiles.
g. Con la Confirmación de la Tramitación de la Reserva, la Administración solicitará al Interesado que dentro de un plazo de CATORCE (14) días naturales confirme la Reserva introduciendo sus datos personales en el portal de los residentes (en adelante, "Portal TCAS").
h. Como parte del proceso de registro a través del Portal TCAS, el Interesado tendrá acceso (i) a un contrato de hospedaje generado previamente (en adelante, el "Contrato Online") y (ii) al Reglamento Interno de Convivencia de la Residencia (en adelante, el "Reglamento").
i. El Interesado y, en su caso, conjuntamente con sus padres o representantes legales en su condición de pagadores (en adelante, los “Pagadores"), habrán de leer atentamente el
Contrato Online y el Reglamento.
j. En el supuesto de que el Interesado y, junto con los Pagadores, en su caso, acepten los contenidos del Contrato Online y del Reglamento, deberá o deberán marcar la casilla prevista en el Portal TCAS a los efectos de aceptar lo recogido en el Contrato Online, así como en el Reglamento. Al hacer clic en "Confirmar", se firmará de forma digital por el Interesado y, en su caso, conjuntamente con los Pagadores, el Reglamento y el Contrato Online para el futuro alojamiento temporal y universitario en la Residencia.
k. En el marco de la entrada a la Residencia (en adelante, el „Check In“) el Interesado y, en su caso, los Pagadores tendrán que firmar a mano un ejemplar original del Contrato de
Hospedaje, así como del Reglamento, según se especifica con más detalle el Contrato Online.
l. La Administración solicitará al Interesado, en su caso, que aporte otros documentos, como una copia de su DNI o pasaporte y el certificado de matrícula en la universidad en
la que el Interesado estudia o va a estudiar, así como hacerle llegar a través de correo electrónico, información adicional sobre el Check In.
m. En el supuesto de que el Interesado o los Pagadores, además de la Reserva, hayan abonado íntegramente el Depósito, de acuerdo con la cláusula 3.- del presente documento, la Administración le enviará un correo electrónico cuatro semanas antes de la fecha de inicio confirmando la Reserva (en adelante, la "Confirmación de la Reserva") y
proporcionando al Interesado información general sobre su entrada en la Residencia (en adelante, el "Check In").
3. Depósito
El Interesado, una vez recibida la Notificación de la Aceptación de Reserva a través de correo electrónico, entregará a Iberian Propco I y según las indicaciones específicas
en la misma, un depósito en efectivo por importe de OCHOCIENTOS EUROS (800,00 €) (en adelante, el “Depósito”), como más tarde 30 días antes del inicio previsto del Contrato de Hospedaje correspondiente. En la fase precontractual, el Depósito tendrá por objeto, entre otros, consolidar la reserva de la plaza en la Residencia. Tras el Inicio del
hospedaje, el Depósito tendrá por objeto garantizar frente a Iberian Propco I los gastos de reparación ocasionados por eventuales daños al inventario en la Habitación, lo que se
especifica con detalle en el Contrato de Hospedaje.
4. Pago de la primera mensualidad
Si el Interesado elige la opción “pago mensual" para el pago del precio regulado en el Contrato de Hospedaje, en su caso a través de los Pagadores, mediante (i)
transferencia mensual o (ii) mediante pago a través de tarjeta de crédito y/o débito mediante el Portal TCAS, el pago de la primera mensualidad deberá realizarse como
máximo 10 días antes del inicio previsto en el Contrato de Hospedaje. A este respecto se establecen los detalles en el Contrato de Hospedaje.
5. Derechos del Interesado en la fase precontractual
a. El Interesado podrá cancelar la Reserva en cualquier momento previo al pago del Depósito a Iberian Propco I, en cuyo caso no tendrá derecho al reembolso de la Reserva,
exceptuando lo previsto en la cláusula 2.- c. del presente documento. La cancelación se deberá comunicar por escrito o por correo electrónico dirigido a favor de
legalspain@youniq.de, sin que sea necesario describir el motivo especifico de la cancelación.
b. Si la cancelación se produce con menos de 30 días de antelación a la fecha prevista de inicio del respectivo Contrato de Hospedaje, Iberian Propco I tendrá derecho a retener y
hacer suyo el importe equivalente al 25% del Depósito en concepto de indemnización por la necesaria reasignación en corto plazo, salvo en los siguientes supuestos: (1) Si el Interesado ha recibido una notificación en la que se le indica que no podrá obtener una plaza en la universidad a la que aspira para completar sus estudios previstos con menos de 30 días de antelación al inicio previsto del respectivo Contrato de Hospedaje. El justificante oficial de la universidad deberá ser adjuntado a la comunicación de la cancelación a Iberian Propco I. (2) Si el Interesado recibe de la administración universitaria la notificación de la suspensión de la totalidad de las clases de los estudios del Interesado acerca del año académico 2021 / 2022 con motivo de la Pandemia con menos de 30 días de antelación al inicio previsto del Contrato de Hospedaje. En la comunicación a Iberian Propco I sobre la cancelación, el Interesado deberá acreditar este hecho dentro de un plazo de tres (3) días naturales desde la recepción de dicha notificación adjuntando un documento fehaciente emitido por parte de la administración de la universidad correspondiente. (3) Si el Interesado no obtiene el visado de entrada a España. En la comunicación a Iberian Propco I sobre la cancelación, el Interesado deberá acreditar este hecho adjuntando un documento fehaciente, emitido por la administración correspondiente dentro de un plazo de tres (3) días naturales desde la notificación correspondiente por la administración pública competente. (4) Si el Interesado no puede volar debido a una prohibición de viajar establecida la misma en el marco de la Pandemia, debiendo acreditar el Interesado este hecho dentro de un plazo de tres (3) días naturales frente a Iberian Propco I.
c. En el supuesto de que la cancelación se produzca con menos de 7 días de antelación al inicio previsto del respectivo Contrato de Hospedaje, Iberian Propco I podrá retener y
hacer suyo el importe equivalente al 75 % del depósito en concepto de indemnización por la escasa anticipación para la reasignación de la habitación, exceptuando los motivos
mencionados en la cláusula anterior, que también serán de aplicación en este supuesto.
d. Iberian Propco I abonará al Interesado el importe correspondiente al Depósito, aplicando en su caso la deducción correspondiente, según las excepciones reguladas en esta cláusula 4.- dentro de los diez días hábiles siguientes a la recepción de la notificación de cancelación, mediante transferencia a la cuenta bancaria indicada a estos efectos en la cancelación.
6. Protección de datos
a. Los datos personales que facilita el Residente y, en su caso, los Pagadores en el marco del Proceso de Reserva y del Contrato de Hospedaje serán tratados de conformidad con el Reglamento 2016/679 del Parlamento Europeo y del Consejo del 27 de abril de 2016 General de Protección de Datos y demás normativa aplicable relativa a la privacidad y protección de datos.
b. En cumplimiento con la normativa aplicable, se informará previamente a todos los usuarios que faciliten o vayan a facilitar sus datos personales. Para más información, el usuario puede consultar la información sobre el tratamiento de los datos personales disponible en la Política de Privacidad en la página web.

1. Object
a. “Youniq Sevilla” is a private, university residence located at Calle Plácido Fernández Viagas, 6, Sevilla, 41013 (the “Residence”), property of the company Iberian Propco I, S.L.U. (“Iberian Propco I”), Spanish Fiscal Identification Number (“NIF”) B87229530, with registered address at Calle Príncipe de Vergara, 112, planta 4ª, 28002 Madrid, managed for and on behalf of Iberian Propco I, S.L.U. by the company Hartly Invest, S.L. (“Hartly Invest”), NIF B88226873, with registered address at Calle Príncipe de Vergara, 112, planta 4ª, 28002 Madrid.
b. By clicking the button “Reserve” on the reservation page enabled for such purpose on the web page of the commercial trademark YOUNIQ (https://youniqliving.com/es) (the "Reservation Process"), the interested party confirms its interest in obtaining a lodging right with Iberian Propco I (the "Reservation"), granted by virtue of the execution of a contract for seasonal accommodation and lodging for university students (the “Lodging Contract”).
c. The interested party (i) is a student enrolled in a Spanish university or (ii) has the intention of beginning to study at a Spanish university during the academic year 2021/2022 or (iii) is a student enrolled in a foreign university and is carrying out part of his/her studies at a Spanish university as part of a study abroad program (for ex. Erasmus+ program) (the
“Interested Party”).
2. Reservation
a. The purpose of the Interested Party’s Reservation is to execute the Lodging Contract with Iberian Propco I and the granting of a lodging right in favour of the Interested Party, in relation to a room in an apartment or studio of the Residence, taking into account the different types of lodging offered by the Residence and which are shown below:

b. With regard to the Reservation, Iberian Propco I shall collect from the Interested Party a non-refundable processing fee, with the exception of what is set forth in Clause 2c, in
the amount of ONE HUNDRED FIFTY EUROS (€150.00), which the Interested Party shall pay during the Reservation Process, providing the payment details and making the subsequent charge using the debit or credit card indicated for these purposes.
c. The Interested Party declares that, in the context of the Reservation Process, he/she knows and accepts that the Reservation is only refundable in the event that Iberian
Propco I fails to indicate the true lack of availability of rooms in the Residence during the Reservation Process, in contrast with the availability indicated on the web page and,
as a consequence, refuses to accept the Reservation of the Interested Party (overbooking).
d. The Interested Party declares, accepts and knows that, in particular, the following cases shall not entitle him/her to claim a refund of the Reservation from Iberian Propco I: (i) the
substitution of in-person classes with online/virtual classes in the context of the current pandemic caused by the virus SARSCoV-2 (the “Pandemic”), or the change from
academic teaching to distance learning or (ii) the total or partial suspension of academic classes due to the Pandemic.
e. Iberian Propco I, through Hartly Invest, may, at its own discretion, decide if it will offer the Interested Party a room in the type of accommodation requested. This will depend
mainly on the availability of the rooms at the Residence.
f. Once the Interested Party initiates the Reservation Process by clicking on the “Reserve” button on the reservation page enabled for such purpose on the YOUNIQ webpage, the administration of the Residence (the "Administration") will send an email regarding the processing of the reservation (the "Confirmation of Reservation Processing") within three
working days.
g. In the Confirmation of Reservation Processing, the Administration will request that the Interested Party confirm the Reservation by introducing his/her personal data in the resident portal ("TCAS Portal") within FOURTEEN (14) calendar days.
h. As part of the registration process through the TCAS Portal, the Interested Party shall be provided with access to (i) a previously generated lodging contract (the "Online Contract") and (ii) to the Internal Code of Conduct of the Residence (the "Code of Conduct").
i. The Interested Party jointly with, where applicable, his/her parents or legal representatives in their capacity as payers (the “Payers"), must carefully read the Online Contract and the Code of Conduct.
j. In the event that the Interested Party together with, where applicable, the Payers, accept the contents of the Online Contract and the Code of Conduct, he/she or they shall mark the box foreseen in the TCAS Portal in order to accept what is included in the Online Contract as well as in the Code of Conduct. By clicking “Confirm,” the Interested Party jointly with, where applicable, the Payers, shall digitally sign the Code of Conduct and the Online Contract for the future temporary and university lodging at the Residence.
k. Within the context of entry to the Residence (the “Check In”) the Interested Party and, where applicable, the Payers, must sign by hand an original of the Lodging Contract, as
well as of the Code of Conduct, according to what is specified in more detail in the Online Contract.
l. The Administration shall request from the Interested Party, if applicable, the submission of other documents, such as a copy of his/her DNI or passport and the certificate of enrolment in the university in which the Interested Party studies or is going to study, as well as send him/her additional information by email regarding Check In.
m. In the event that the Interested Party or the Payers, in addition to the Reservation, have fully paid the Deposit, in accordance with Clause 3 of this document, the Administration
shall send them an email four weeks prior to the start date confirming the Reservation (the "Reservation Confirmation") and providing the Interested Party with general information
regarding his/her entry at the Residence (the "Check In").
3. Deposit
The Interested Party, once he/she has received the Notification of Acceptance of the Reservation by email, shall provide Iberian Propco I, pursuant to the instructions contained in such email, with a cash deposit of EIGHT HUNDRED EUROS (€800.00) (the “Deposit”), no later than 30 days prior to the start date foreseen of the corresponding Lodging Contract. During the precontractual phase, the Deposit shall be intended, inter alia, to consolidate the reservation of a place at the Residence. After the Start of the lodging, the Deposit shall be intended to guarantee vis-à-vis Iberian Propco I any repair expenses arising due to possible damage to the inventory in the Room, as specified in detail in the Lodging Contract.
4. First monthly payment
If the Interested Party chooses the “monthly payment” option to pay the price governed in the Lodging Contract, where applicable through the Payers, by way of (i) a monthly
bank transfer or (ii) payment by credit and/or debit card using the TCAS portal, the first monthly payment must be made at the latest 10 days prior to the start date foreseen in the
Lodging Contract. In this regard, the details are established in the Lodging Contract.
5. Rights of the Interested Party in the precontractual phase
a. The Interested Party may cancel the Reservation at any time prior to payment of the Deposit to Iberian Propco I. In this case he/she shall not be entitled to a refund of the
Reservation, with the exception of the case foreseen in Clause 2c of this document. Cancellation must be notified in writing or by email addressed to legalspain@youniq.de,
where it shall not be necessary to specify the reasons for the cancellation.
b. If the cancellation is made less than 30 days prior to the start date of the respective Lodging Contract, Iberian Propco I shall be entitled to retain and make its own an
amount equivalent to 25% of the Deposit as compensation for the necessary reassignment of the room in a short term, except in the following cases:
(1) If Interested Party receives a notification indicating that he/she will not be able to enrol in the university to complete the studies foreseen with less than 30 days’ notice prior
to the start date foreseen of the respective Lodging Contract. The official notification from the university must be attached to the communication of the cancellation to Iberian
Propco I.
(2) If the Interested Party receives notification from the corresponding university administration indicating that all of the classes in the Interested Party’s study program for academic year 2021-2022 have been suspended due to the Pandemic. In the communication to Iberian Propco I regarding the cancellation, the Interested Party must prove this fact within three (3) calendar days from receipt of said notification, attaching an irrefutable document issued by the administration of the corresponding university.
(3) If the Interested Party does not obtain an entry visa for Spain. In communication to Iberian Propco I regarding the cancellation, the Interested Party must prove this fact,
attaching an irrefutable document issued by the corresponding administration within three (3) calendar days from the corresponding notification by the competent public
administration.
(4) If the Interested Party may not fly due to a prohibition on travelling established in the context of the Pandemic, where the Interested Party must prove this fact within
three (3) calendar days to Iberian Propco I.
c. In the event that a cancellation takes place with less than seven days’ notice with respect to the start date foreseen of the respective
Lodging Contract, Iberian Propco I may retain and make its own an amount equivalent to 75% of the deposit as compensation for the scarce notice for the re-assignment of the
room, with the exception of the reasons mentioned in the preceding clause, which shall also apply in this case.
d. Iberian Propco I shall pay the Interested Party the amount corresponding to the Deposit applying, if applicable, the corresponding deduction, pursuant to the exceptions stipulated in this Clause 4, within 10 working days following receipt of the notification of the cancellation, by way of a bank transfer to the bank account indicated for these purposes in the cancellation.
6. Data protection
a. The personal data provided by the Resident and, if appliable, the Payers in the context of the Reservation Process and the Lodging Contract shall be processed pursuant to the provisions of Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016, the General Data Protection Regulation and other applicable regulations relative to data privacy and protection.
b. In compliance with the applicable regulations, all users who provide or will provide their personal data shall be informed beforehand. For more information, the user may consult the information on the processing of personal data in the Privacy Policy on the web page.
